Court Decision for Three Peoria Policemen

A partial victory Friday for three Peoria Police officers, accused of misconduct in connection with the alleged beating of a Peoria man last May. The prosecution wanted the city to turn over statements the officers allegedly made during an internal investigation. However, the judge in his ruling Friday said prosecutors cant use those statements, claiming it would violate the officers constitutional rights. However, the judge said prosecutors could use statements made by other officers in connection with the May 2008 incident. 29 year old Andrew Smith and 39 year old Gerald Suelter are each facing a seven count indictment, charged with four counts of official misconduct, aggravated battery, battery and mob action. A third officer, 31 year old Jeremy Leyman is charged with obstructing justice and official misconduct. All three officers have pleaded NOT GUILTY. The charges stem from a May third 2008 police pursuit and subsequent arrest of 34 year old Bryce Scott at Abington and Perry. Scotts attorney says Scott was beaten, tased and doused with pepper spray after the chase.
