Marshall County Man Indicted for Murder

The Marshall County man, accused of killing his estranged girlfriend, was named Wednesday in a four count murder indictment. 39 year old Tony Smith, who was shot by a Lacon policeman during the incident, is accused of killing Judith Berchtold of Sparland April 11th with five shotgun blasts after ramming her car with his vehicle in Sparland. States Attorney Paul Bauer may seek the death penalty. Smith, whose being held without bond, will be back in court Monday, May 11th.
